A Critical Analysis of Thomas Aquinas’ Principle of Double-Effect and the Natural Law

Abstract

This paper discusses the principle of double effect, with emphasis on its formulation, historical development and applications. The discussion is expository, analytic and critical in its methodology. Although, there are so many cases to which the principle of double effect is applicable, I shall briefly mention some of the cases, but offer a detailed treatment of only two of them. Also, an attempt will be made to flesh out the distinction between the motive and intention for moral actions, for therein lies much of the confusion regarding this principle. Some traditional criticisms against this principle, and some misconceptions, will be highlighted and responded to. In the conclusion, it will be argued (in support of Thomas Aquinas) that the principle of double effect fits in well with Aquinas‘ natural law tradition, and that Aquinas‘ notion of natural law offers a valuable explanation for certain human actions. The idea is to provide some explanatory models, that do not violate traditional medical morality, addressing certain critical moral and medical issues.
